By accessing or using our website or voluntarily providing personal information to FlowStartX, you acknowledge the practices described in this Privacy Policy.

 

This Privacy Policy applies to FlowStartX's website, programs, workshops, events, consultations, communications, registrations, transactions, and other interactions with FlowStartX, whether conducted online or offline, unless a different privacy notice expressly applies.

The information FlowStartX collects depends upon how you interact with us.

When you register for or participate in a FlowStartX program, workshop, consultation, event, or other service, we may collect information reasonably necessary to administer your participation, such as:

  • Information you voluntarily provide to FlowStartX during the program or event

FlowStartX does not require participants to provide confidential or proprietary business information except where reasonably necessary for a particular service and expressly requested.

When you make a purchase, registration payment, or other financial transaction, payment information may be collected and processed by third-party payment processors, commerce platforms, financial institutions, or other service providers used by FlowStartX.

FlowStartX may receive transaction-related information such as your name, contact information, transaction amount, payment status, date of transaction, purchased service, and transaction identifier.

FlowStartX generally does not directly receive or store complete payment-card numbers when payment information is processed by a third-party payment processor.

If you provide FlowStartX with your email address or telephone number, we may use that information to send communications relating to your inquiries, purchases, registrations, appointments, programs, events, or other interactions with FlowStartX.

Where permitted by applicable law and where any required consent has been obtained, we may also send promotional or marketing communications.

You may unsubscribe from promotional emails by using the unsubscribe mechanism provided in the applicable message.

You may withdraw consent to promotional text messages through the opt-out method identified in the message or by otherwise communicating a reasonable request to stop receiving such messages.

Opting out of promotional communications does not necessarily prevent FlowStartX from sending non-promotional communications reasonably necessary to administer a transaction, registration, program, contractual relationship, safety matter, or other service you requested.

FlowStartX may use third-party communication providers to deliver email or SMS communications.

 

5. PHOTOGRAPHY, AUDIO, VIDEO AND RECORDINGS

FlowStartX programs, workshops, corporate sessions, Builder Experiences, events, presentations, interviews, and other activities may be photographed, livestreamed, audio recorded, or video recorded.

Recordings may contain an individual's image, likeness, voice, statements, participation, or other information.

Where applicable, FlowStartX may use such recordings for purposes authorized by an applicable participant agreement, media release, contractual agreement, consent, or other authorization.

Such purposes may include program documentation, education, training, internal business use, advertising, marketing, promotional materials, social media, websites, presentations, publications, and other lawful business purposes.

This Privacy Policy does not itself constitute a media release or replace any consent or authorization that may be required by applicable law or a separate agreement.

Specific recording and media-use rights may therefore be governed by separate participant terms, corporate agreements, media releases, notices, or authorizations.

 

6. ARTIFICIAL INTELLIGENCE AND FLOWAI

FlowStartX may provide education or instruction concerning the use of third-party artificial intelligence tools as part of certain educational programs, including FlowAI.

FlowStartX does not operate an artificial intelligence system that collects, stores, processes, or maintains participant or client business data.

Participants using third-party artificial intelligence tools interact with those third-party services independently.

FlowStartX does not receive, access, store, or process through FlowStartX systems the business information that participants independently submit directly to third-party artificial intelligence services.

Information submitted by a participant directly to a third-party artificial intelligence provider is subject to that provider's own terms, privacy practices, security practices, and data policies.

Participants are responsible for evaluating what information they choose to provide to third-party artificial intelligence services.

 

7. COOKIES AND SIMILAR TECHNOLOGIES

Our website and service providers may use cookies, pixels, tags, analytics technologies, or similar technologies to operate the website, remember preferences, understand website activity, measure performance, improve services, maintain security, and, where applicable, support advertising or marketing activities.

Some technologies may be necessary for website functionality. Others may be controlled through available browser settings, cookie-management tools, or consent mechanisms.

Disabling certain technologies may affect website functionality.

Where required by applicable law, FlowStartX will provide applicable choices concerning nonessential cookies or similar technologies.

FlowStartX does not sell personal information for money as part of its ordinary business model.

Certain advertising, analytics, cookie, or marketing technologies can, however, constitute a “sale,” “sharing,” or targeted advertising under some privacy laws even when no money is exchanged.

To the extent FlowStartX engages in activity legally classified as selling or sharing personal information, FlowStartX will provide any notices, consent mechanisms, opt-out methods, or other rights required by applicable law.

FlowStartX will honor legally recognized opt-out preference signals, including Global Privacy Control, to the extent required by applicable law.

Retention periods may vary depending upon the nature of the information and the purpose for which it is maintained.

When information is no longer reasonably necessary, FlowStartX may delete, destroy, anonymize, or de-identify it, subject to applicable law and reasonable technical limitations.

FlowStartX takes reasonable administrative, technical, and organizational measures appropriate to the nature of the information in its possession and the circumstances of its operations.

We may also rely upon third-party service providers that maintain their own security safeguards.

However, no method of electronic transmission, storage, website operation, or information-security system can be guaranteed to be completely secure.

Accordingly, FlowStartX cannot and does not guarantee the absolute security of personal information.

Users are also responsible for taking reasonable precautions when transmitting information electronically and should avoid sending highly sensitive information through ordinary email or other unsecured communication methods unless necessary.

 

13. THIRD-PARTY WEBSITES AND SERVICES

Our website, programs, communications, or materials may contain links to websites, platforms, applications, social-media services, payment services, artificial intelligence services, or other resources operated by third parties.

FlowStartX does not control the privacy, security, content, or data practices of independent third parties.

This Privacy Policy does not govern information you provide directly to an independent third party.

You should review the privacy policies and terms of third-party services before providing information to them.

 

14. THE MOTIVATION EFFECT AND OTHER ORGANIZATIONS

FlowStartX may from time to time provide information about, link to, collaborate with, or facilitate opportunities to support separate organizations, including The Motivation Effect.

The Motivation Effect is separate from FlowStartX.

If you leave FlowStartX's website or provide information directly to a separate organization, that organization's privacy policy and practices govern the information collected directly by that organization.

The presence of a link, donation opportunity, collaboration, or reference on a FlowStartX website does not cause information independently collected by another organization to become information controlled by FlowStartX.

 

15. ADULTS ONLY

FlowStartX's website, services, programs, and offerings governed by this Privacy Policy are intended for individuals 18 years of age or older.

FlowStartX does not knowingly solicit personal information through these services from children under 18.

If we learn that information has been collected through a FlowStartX service from an individual under 18 in circumstances where such collection was not intended or authorized, we may take reasonable steps to delete the information as appropriate.

Separate youth programs operated by another organization, including programs that may be associated with The Motivation Effect, are not governed by this Privacy Policy merely because FlowStartX may reference or support them.

 

16. YOUR PRIVACY CHOICES

Depending upon where you reside and the laws applicable to FlowStartX, you may have rights concerning your personal information.

These rights may include the ability to request:

  • Access to personal information;

  • Information concerning categories of information collected;

  • Correction of inaccurate personal information;

  • Deletion of certain personal information;

  • A copy of certain personal information;

  • Information concerning how personal information is used or disclosed;

  • Opt-out from certain sales, sharing, or targeted advertising;

17. CALIFORNIA PRIVACY RIGHTS

FlowStartX is organized in California and respects privacy rights available to California residents.

The California Consumer Privacy Act, as amended (“CCPA”), applies to businesses that satisfy specified statutory requirements. Nothing in this Privacy Policy constitutes a representation that FlowStartX presently meets every threshold necessary to be classified as a business subject to every provision of the CCPA.

Where the CCPA or another California privacy law applies to FlowStartX and a particular individual or processing activity, eligible California residents may have rights including:

  • The right to request deletion;

  • The right to request correction;

  • The right to opt out of qualifying sale or sharing;

  • The right to limit certain uses or disclosures of sensitive personal information, where applicable; and

Where permitted by law, FlowStartX may decline requests that cannot reasonably be verified, are fraudulent or abusive, conflict with legal obligations, interfere with the rights of others, or fall within another lawful exception.

Authorized agents may submit requests where applicable law permits them to do so, subject to appropriate verification of their authority.

 

19. DO NOT TRACK AND PRIVACY PREFERENCE SIGNALS

Some browsers provide “Do Not Track” functionality. Because there is not necessarily a uniform legal or technological standard governing all Do Not Track signals, our website may not respond to every such signal.

Where applicable law requires FlowStartX to recognize a legally valid browser-based opt-out preference signal, such as Global Privacy Control, FlowStartX will endeavor to process that signal as required by applicable law.

FlowStartX is based in the United States.
